Terms of Service

1. Acceptance of Terms

By accessing or using Kolsona at kolsona.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

These Terms apply to all users of the Service, including DJs and event hosts who create and manage events, and guests who participate in event surveys.

2. Eligibility

You must be at least 13 years of age to use Kolsona. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained the consent of a parent or legal guardian to use the Service.

3. User Accounts

To create events and access the DJ dashboard, you must sign in using Google Sign-In. You are responsible for all activity that occurs under your account.

Kolsona reserves the right to suspend or terminate accounts that violate these Terms, at its sole discretion and with or without prior notice.

4. Account Security

You are responsible for keeping your Google account credentials secure. If you suspect unauthorized access to your Kolsona account, notify us immediately at support@kolsona.com.

5. Permitted Use

Subject to these Terms, Kolsona grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose: collecting audience music preferences for live events you organize or perform at.

6. Prohibited Conduct

You may not:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Collect data from guests for any purpose other than understanding their music preferences for your event
  • Use the Service to harass, intimidate, or harm other users
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Use automated tools to scrape, crawl, or systematically extract data from the Service
  • Share your event QR code or link in a deceptive context that misleads guests about the nature or purpose of the survey
  • Include unlawful, offensive, defamatory, or harmful content in event descriptions, questions, or other submissions
  • Interfere with or disrupt the integrity or performance of the Service

7. User Content

Event content. When you create event descriptions, survey questions, or other content, you represent that you have the right to submit that content and that it does not violate any applicable law or third-party right. You retain ownership of the content you create. By submitting content to Kolsona, you grant us a limited, worldwide license to display and process that content solely to provide the Service.

Guest survey responses. Guests who respond to your surveys represent that their responses are genuine and do not contain harmful or unlawful content. As the event host, you are responsible for ensuring your event surveys are used appropriately and in accordance with these Terms.

Responsibility of event hosts. You are responsible for how you use the audience data collected through your events. You may not use that data to contact, track, or target guests outside the context of the event for which it was collected.

8. AI-Generated Content

Kolsona may offer AI-assisted features that suggest event questions or related content. AI suggestions are provided as a convenience only. They are not guaranteed to be accurate, appropriate, or complete.

You are responsible for reviewing and approving all AI-generated content before using it in your events. Kolsona makes no representation that AI outputs are free from errors, biases, or inaccuracies. Reliance on AI-generated content is at your own risk.

9. Intellectual Property

The Kolsona platform - including its design, code, brand, visual identity, and platform-level content - is owned by or licensed to Kolsona and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, reverse engineer, or create derivative works from the platform without our prior written consent.

Feedback you provide about the Service may be used by Kolsona to improve the product without any obligation or compensation to you.

10. Service Availability

We strive to provide reliable access to the Service, but we do not guarantee uninterrupted or error-free availability. We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice.

11. Suspension and Termination

We may suspend or terminate your access to the Service at any time if we determine, at our sole discretion, that you have violated these Terms, that your use poses a risk to the platform or other users, or for any other reason we deem appropriate.

You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability, and indemnification - will continue to apply after termination.

12. Account Deletion

You may request deletion of your account at any time by contacting support@kolsona.com. Upon deletion, your account information and event data will be removed. Guest survey data linked to your events will also be deleted.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Kolsona does not warrant that the Service will meet your requirements, that access will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Kolsona and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the Service, even if advised of the possibility of such damages.

Our total liability to you for any claims arising out of these Terms or your use of the Service shall not exceed the greater of: (i) the amounts you paid to us in the twelve months preceding the claim, or (ii) one hundred US dollars (USD 100).

15. Indemnification

You agree to indemnify, defend, and hold harmless Kolsona and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) content you submit through the Service.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Israel.

17. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
